Creating a valid will is essential, but it often requires legal expertise to ensure it meets all legal requirements. As of January 1, 1954, wills must be in writing, the testator must be at least 16 years old, and their signature must appear on every page of the will and at the end. These signatures must be made in the presence of two or more competent witnesses. A well-drafted will typically includes specific clauses to simplify estate administration and protect beneficiaries' inheritances from spousal insolvency, among other considerations. Dealing with the administration of a deceased estate can be a daunting task. It involves multiple steps, such as reporting the estate to legal authorities, identifying and collecting estate assets, managing tax affairs, settling debts, and distributing assets to heirs. The legal requirements are stipulated in the Administration of Estates Act 66 of 1965, which mandates the reporting of a deceased estate within 14 days of the individual's passing.
