Fiduciary Services
Your Compassionate and Expert Support
At Resolute Services, we understand that the processes involved in managing estates, wills, and trusts can be overwhelming, especially during emotionally challenging times. In a world often characterized by impersonal transactions, we offer a personal and empathetic touch. Our fiduciary services encompass estate administration, will drafting, and trust management, all designed to simplify complex matters and provide clarity.
Creating a valid will is essential, but it often requires legal expertise to ensure it meets all legal requirements. As of January 1, 1954, wills must be in writing, the testator must be at least 16 years old, and their signature must appear on every page of the will and at the end. These signatures must be made in the presence of two or more competent witnesses. A well-drafted will typically includes specific clauses to simplify estate administration and protect beneficiaries' inheritances from spousal insolvency, among other considerations. We tailor your Last Will and Testament to your unique needs, wishes, and circumstances, preventing future claims, legal disputes, and inquiries from authorities.
Dealing with the administration of a deceased estate can be a daunting task. It involves multiple steps, such as reporting the estate to legal authorities, identifying and collecting estate assets, managing tax affairs, settling debts, and distributing assets to heirs. The legal requirements are stipulated in the Administration of Estates Act 66 of 1965, which mandates the reporting of a deceased estate within 14 days of the individual's passing. We recognise the emotional toll this process takes on families. With our strong relationships with the Master's Offices and the South African Revenue Service (SARS), we handle the formalities, allowing you to focus on coping with the loss of a loved one.
Trusts come in two forms: inter-vivos trusts created by living individuals through a trust deed and testamentary trusts arising from valid wills. All trusts must be registered with the appropriate Master's Office and SARS. As trustees, our primary duty is to uphold the terms defined in the trust deed, safeguarding the best interests of beneficiaries. This includes managing, investing, and distributing trust assets, maintaining transparent accounting records, meeting tax obligations, and adhering to governing laws while ensuring the beneficiaries' welfare.
